On what grounds would he have for such an action? "Hi, yes, I'm a minor who gambled, my employer suspended me, and I want you to lift the suspension."

Yes, it's stupid, but if you wanted to take a legal route, the team is in the right. The team didn't break the law and they could make the case that the kid did.

I would go more along the lines of "reduce the suspension"... unreasonable time length. I could see one or two games, but not six.

It's not necessarily gambling either. You can look at it as a job that Brad Penny gave the boy to do. It's like "clean my room and I'll give you $500", but instead of cleaning a room, it's "drink this gallon of milk and I'll give you $500".

Well, you're assuming the kid could afford a smart lawyer on his batboy's salary

HA HA, not trying to defend but the point here is gambling, not milk. Has no one learned anything from Pete Rose? No doubt however, guys bet on things all the time in the clubhouse, and yeah it is stupid.

Is there a link to this story, as it is vague. More info would be good

Marlins suspend batboy for milk-drinking dare

    ESPN.com news services

Milk does a body good, but it didn't do good for one batboy.

On a dare, a Florida Marlins batboy tried to drink a gallon of milk in under an hour without throwing up. But not only did the batboy not succeed in the challenge, his mere attempt cost him his job for six games, the Miami Herald reported Wednesday.

The Marlins suspended the unidentified batboy for the team's upcoming six-game homestand against the Cardinals and Mets from Aug. 28 through Sept. 4 for accepting the dare Sunday from Dodgers pitcher (and former Marlin) Brad Penny.

Penny offered the batboy $500 if he could drink a gallon of milk in less than an hour before Sunday's game without throwing up. Penny told the paper the boy drank the milk and didn't throw up, but didn't finish the gallon in the allotted time frame to win the dare.

"It's kind of ridiculous that you get a 10-game suspension for steroids and a six-game suspension for milk," Penny told the Herald.

''It's ridiculous that they worry about stuff like that. It shows they [the Marlins organization] don't know anything about the game. That kind of stuff goes on everywhere. It didn't affect the way he worked, the way he did his job.''

Penny should give the kid the $500 now since the kid can't work for 6 games.

Penny should be held accountable for child abuse.

What would happen had the kid's father made the same offer, and the kid got sick enough to need professional help?

Penny should be suspended and ordered to give the kid the $500.

    I've been there.

    I'm presently watching the Angels-Orioles game...0-0. Hot out here today....high 90's.

BTW...I'm a transplanted New Englander, and although I have become a Laker and an Angel fan, I still LOVE the Pats .

Glad the Red Sox won the series...they might have a bit more difficult time beating the Angels this year in a playoff.

Laker fan? I could use an ally against Laker haters even if you're from Celtic Nation.
