Re: McCourt vs McCourt (Frank fires Jamie)

Wish you could have been there, because here's where it gets really silly. Almost a dozen lawyers, millions spent on their fees and Frank's guy puts a picture of a bird's nest with three eggs on the big screen, above it the headline: "Jamie's nest egg."

Then he adds a picnic basket with eggs alongside Jamie's nest eggs, the headline above it: "Frank's basket." Between the basket and nest egg he has a brick wall to signify Jamie's interest in not sharing in Frank's risky ventures.

I can report with some certainty, no eggs were broken in the making of the visual aids.

So glad that millions in lawyer fees are being put into such good use.

The word is Larry Silverstein, the Boston attorney who made the supposed drafting error on the MPA, will be available to testify. For Frank's sake, he better show up, especially after Leah Bishop, estate planning attorney who reviewed the MPA, recounted a different story of Frank's original intended effect of MPA.

Susman is a shark. He's chewed out Bishop, although she's hanging in there. Wait 'til he goes after Jamie. But it's Boies vs Frank next. Expect Boies to hammer Frank over the infamous clerical error.

    Molly Knight (molly_knight) on Twitter

Susman still crossing Leah Bishop hoping to break her. She looks like she's about to pass out but she's holding her own.

Susman going in circles and getting close to the kill but she's deflecting it really well.
    Boies grilling Frank:
Frank got backed into testifying Jamie's intent was to protect the houses, not necessarily sign over the team. He's getting jerked around.

Re: McCourt vs McCourt (Frank fires Jamie)

Josh: Boies got Frank to mostly admit to seeing the Cal Exhibit A. Frank also sort of admits to not reading the MPA...so there goes that argument against Jamie.

Molly: Frank trying to get make the "I didn't read it" defense as it pertains to those drafts. Same argument his lawyers are crucifying Jamie for.
Three drafts were sent to Frank the day before the MPA was signed. All three EXCLUDED the #Dodgers from his take.

In other news, California Attorney General and gubernatorial candidate Jerry Brown is investigating the Dodgers Dream Foundation charity organization.

Here we go: Frank now testifying when he bought the team the lynchpin of his business plan was to "significantly reduce player compensation." Trying to get numbers on planned payroll reduction. I was told by multiple people involved in the deal that $80 million/yr was the target.
The bastard finally admits it. Now can he and Jamie kindly please get the **** out and get the team a new owner(s)?

It should have been noted earlier that was the business plan that Frank submitted to MLB in his application to buy the Dodgers. The $85 million/yr target was to be effective by the 2006 season. But in reality that year's payroll was $98 million. Still, we can connect the dots as to why they didn't re-sign Adrian Beltre.

Heard this at lunch: Susman might not cross-examine Jamie. Frank's team might have their whipsmart ingenue, Victoria Cook, do it.
Boies: "They've gotta deal with the switched schedule. They haven't done that."
Susman on today's main points: "Error on Exhibit A was a mistake. Frank had nothing to do with switching document. No fraud. No chicanery."
Whoever loses on MPA is likely to appeal. With the logjam in CA courts now, that could take up to 36 months, I'm told. Worst case, obvs.

Lawyer testifies he switched L.A. Dodgers ownership document | L.A. NOW | Los Angeles Times
The lawyer who negotiated the now-disputed agreement between Frank and Jamie McCourt testified Tuesday he had switched a page that excluded Frank McCourt from sole ownership of the L.A. Dodgers to one that granted him sole control after the couple had signed the agreement.
someone tweeted that the lawyer is going to end up paying Frank's buyout to Jamie.

McCourt battle may be headed to mediation - MLB - Yahoo! Sports
LOS ANGELES – In the trial that will decide ownership of the Los Angeles Dodgers, the lawyers for Frank and Jamie McCourt have agreed to re-enter discussions about a possible settlement, Yahoo! Sports has learned, an outcome that presumably would allow Frank McCourt to continue as owner of the club.

The potential of returning to mediation – an attempt at settlement failed in August – was hatched between rival attorneys over a lunchtime break in the second-floor corridors of the Stanley Mosk Courthouse, and scheduled for later in the week. In August, Jamie requested a lump sum (believed to be for less than $100 million) and a percentage of the team’s future revenues. Frank rejected it.
I knew the cocksucker would cave.

Closing arguments are over. Judge Gordon is officially on the clock for 90 days. God help us if Frank and Jamie happen to settle before then.

Frank McCourt Divorce: Settlement Talks Break Down - Los Angeles News - The Informer
Frank and Jamie McCourt met with a mediator on Saturday, but came away no closer to a settlement that would end their contentious divorce proceedings, according to an attorney involved in the case.

The two sides remain miles apart. Frank continues to refuse any arrangement that would give Jamie a continuing interest in the Dodgers, while Jamie won't accept anything less, in the belief that Frank doesn't have enough cash on hand to buy her out.
Good, can only hope they stick to their guns. I want the judge to either declare the team community property, thereby forcing a sale, or at least cut Jamie out of the picture.

If Frank loses he will ask for a new trial. He is expected to argue Dodgers were always his separate property because he bought (cont) the parking lot (in Boston) that he eventually traded for the Dodgers two years before he married Jamie. Compelling stuff. No end in sight.
