    Josh Hancock's dad to file a lawsuit

    ESPN.com: Hancock's father files suit against restaurant

    Against:
    a) the restaurant's owner for serving Hancock drinks
    b) the restaurant's manager
    c) the man whose truck broke down for being "negligent" by not moving it out of the way of oncoming traffic
    d) the towing company
    e) the towtruck driver

    Don't forget the pipe and weed he had, and the fact he was on the phone and not using his seatbelt.

    I guess he'll want to sue the pipe-maker, the phone company, and the car manufacturer.

    You had to have seen this coming. Hes just trying to save some face for his son. But hes not going to win any of these lawsuits.

    How about he join the crusade against drinking and driving and preach to everyone that they shouldn't do it, less they meet the same fate as his son?

    Considering how much Im against drinking and driving. The girl ive been talking to has been a major factor when it comes to this issue. She read about a story with Jeremy Cole and had followed the whole story for about a year. Chatting back and forth with the family. What happened was Jeremy and his then girlfriend got really hammered one night in Olympia (captial of Washington for those geographically challenged). Jeremy was in the passenger seat with his girl behind the wheel. They got to this 3 way stop off a hill and she lost control going about 70 (that could be wrong but it was well above the speed limit of 35). Jeremy was killed on impact going down the hill and she lived. What bothers her is the fact that the driver is still driving and going to bars and drinking but Jeremy had a son and he will never get to see his father because of that bad decision. They had the pre-trial for Jeremy's then girlfirend's trial on Tuesday. You probably could cut the tension with the knife to put a long story short. The Girlfriend didnt have any remorse for what she did and even smiled after the trial got pushed back. Which if the girl I was talking two didn't have two kids of her own. Shed be in jail from kicking the snot out of her, broken leg and all.

    And that's what makes it a lot worse.

    A lot of times it's not the drunk driver that's killed, but an innocent person who got hit by the drunk driver. (Or, in that case, a guy riding with her in the same car.)

    They were both drunk at the time, so if either were behind the wheel. I think the same result would have happened anyways. The fact that it bothers her so much even know she has never met Jeremy is what kind of impact it has on her.

    He has a suit against the restaurant. Restaurants and bars can be held liable for negligence when they continue to serve alcohol to someone who's clearly intoxicated.

    thats the only one he has it against, and they indeed are negligent if they continue to serve an overserved person who is known to have drinking problems.

    So nobody's allowed to get drunk now? less the bars/restaurant get sued?

    I don't think the onus should be on the bar/restaurant to know who's planning on driving home and who has a designated driver. And if somebody has a designated driver he should be able to get as intoxicated as he damn well pleases.

    I mean, common sense comes into play at some point, and there is a point in which they should cut somebody off...but that point is well past the point in which someone should not be getting behind the wheel.

    he's also very dead. he paid for his negligence. There is personal responsibility of course. But, speaking as someone who has been cut off, there are laws on the books (in some states at least) that bars that continue to serve overserved people if they go out and kill someone while driving.

    is it just because hancock was the only one killed? because if it was say the guy who was wrecked to begin with or the tow truck guy, you can bet THEIR family would have sued the hell out of the resteraunt.
