Re: Bryan Stow's family is suing the Dodgers
You can, doesn't mean you'll win but you can. The comparisons aren't the same but I can kind of see where you are going.

You can, but I would think it would be much harder to win the case. The security company that is hired to watch the Dodgers Stadium area has a certain area to watch. They apparently did not do that or had insufficient workers to do so. The city has a much larger range to cover so I would imagine it to be harder to prove they did not have the proper coverage of staff the night of the mugging.
Re: Bryan Stow's family is suing the Dodgers
The same concept still fits. There is no such thing as perfect security so it seems stupid to me to blame the team when they had security in place.
they're only doing this because the criminals can't afford to pay for a lost lawsuit and the Dodgers can....wait, that's probably not true.

Read this Leo, it makes a lot of sense. If the Dodgers failed to beef up security after past incidents, the Dodgers do have to take some blame. That's what the Stow family will try and prove.
Re: Bryan Stow's family is suing the Dodgers
The lawsuit goes as far as to blame the Dodgers for refusing to relocate Opening Day to San Francisco as one of the reasons the attack took place. I love the fact their lawyers are being paid to come up with ridiculous allegations to sneak into the suit.

44. The 2011 schedule was finalized by Major League Baseball prior to the completion
of the 2010 season. Therefore, at the time the schedule was set it was unknown that the Giants
would win the World Series in 2010. After the Giants victory, the San Francisco Giants requested
that Opening Day be relocated to Park in San Francisco, California so they could celebrate
the World Series victory in front of hometown fans. Major League Baseball agreed to change the
location if the DODGERS DEFENDANTS would agree to the relocation. The DODGERS
DEFENDANTS refused to change the location to accommodate the Giants.

McCourt may not be able to afford it, but I'm sure the Stow family will just go after MLB or whoever is the next owner of the Dodgers.

There is no way they are going to win that part of the case. Well I should say never. We all know what our justice system is like.

The problem was its been a chronic problem for the Dodgers and they did nothing to fix it... thats negligence
Re: Bryan Stow's family is suing the Dodgers
I'll agree McCourt is fucked on gross negligence. However, extra b.s. charges like the one I quoted will just annoy any judge and jury worth their salt.

its their job to lay out any all possible lines they will use in the trial...even the crazy ones...
Re: Bryan Stow's family is suing the Dodgers
there are muggings in New York City every year. Is the NYPD negligent for not preventing them?

NYC does everything they can do to prevent them... that makes them not negligent... LAD didn't do everything they could, even though its been a chronic problem... thats the differnece

What more could they have done? Short of adding more security?
(Because I can make the same argument that they should add more police to the NYPD force)

The Dodgers had the resources to add more security, NYC doesn't... hence how NYC is doing everything it can, and the Dodgers didn't... don't blame me blame the legal system
